The proposal would have been the first fracking off California&#8217;s coast in more than a decade. The vote comes after the commission released <a href="https://www.californiaenergyjournal.com/p/coastal-commission-staff-reports">two staff reports</a> on the project in July. <a href="https://www.californiaenergyjournal.com/p/california-coastal-commission-objects">Read more</a>.</p><p><strong>Western Gateway Pipeline to Move Forward, Creating New Fuel Route into California </strong>(August 12, 2026) &#8211; Phillips 66, Kinder Morgan and HF Sinclair have made a final investment decision to proceed with the $5 billion Western Gateway Pipeline, a 1,300-mile refined-products system designed to transport fuel from the Midwest and Gulf Coast to Arizona and California. The companies announced August 11 that they had finalized a joint venture agreement for the project. The vote comes after the commission released <a href="https://www.californiaenergyjournal.com/p/coastal-commission-staff-reports">two staff reports</a> on the project in July.</p><p class="button-wrapper" data-attrs="{&quot;url&quot;:&quot;https://www.californiaenergyjournal.com/subscribe?&quot;,&quot;text&quot;:&quot;Subscribe now&quot;,&quot;action&quot;:null,&quot;class&quot;:null}" data-component-name="ButtonCreateButton"><a class="button primary" href="https://www.californiaenergyjournal.com/subscribe?"><span>Subscribe now</span></a></p><p>The commission staff determined that the proposed project was inconsistent with California coastal protection policies because it would extend production from aging offshore infrastructure and increase the risk of oil spills that could harm marine ecosystems, commercial fishing, and other coastal resources. Commissioners also objected to a separate consistency determination submitted by the federal Bureau of Ocean Energy Management covering the project.</p><p>DCOR proposed to conduct fracking operations over five years, increasing oil production on Platform Gilda from approximately 1,100 barrels per day as high as 4,000 barrels per day. The project&#8217;s environmental review projected production of approximately 14 million barrels of oil and 13 million additional cubic feet of natural gas over the next 20 years. An analysis submitted to the commission estimated that fracking would yield approximately 8 million to 8.5 million more barrels than continued conventional production.</p><p>Platform Gilda, installed in 1981 and located roughly nine miles offshore of Ventura County, has produced approximately 42.6 million barrels of oil and 51.7 billion cubic feet of natural gas as of the end of 2025, according to the Bureau of Safety and Environmental Enforcement.</p><p>Because the platform is more than three nautical miles offshore, in the federal Outer Continental Shelf, the project is outside state waters and is not directly covered by California&#8217;s <a href="https://www.californiaenergyjournal.com/p/fracking-ban-regulations-approved">statewide prohibition</a> on hydraulic fracturing.</p><p>Offshore fracking, however, has been subject to a federal court prohibition since a <a href="https://www.environmentaldefensecenter.org/programs_press_type/parent-room/judge-denies-oil-companys-request-to-continue-fracking-offshore-california-despite-moratorium/">2019 order</a> barred federal agencies from authorizing well-stimulation treatments until they completed the environmental reviews required by federal law. In 2022, the Ninth Circuit upheld rulings that the federal government had violated the National Environmental Policy Act, Endangered Species Act and Coastal Zone Management Act. The U.S. Supreme Court <a href="https://www.californiaenergyjournal.com/p/us-supreme-court-declines-to-review">recently declined</a> to review that decision.</p><p><span>In March, the Bureau of Ocean Energy Management (BOEM) initiated a </span><a href="https://www.californiaenergyjournal.com/p/boem-moves-to-fast-track-environmental"><span>fast-tracked environmental review</span></a><span> of the project and </span><a href="https://www.californiaenergyjournal.com/p/boem-issues-final-environmental-review"><span>completed the review</span></a><span> in April. The Trump administration contended that this review satisfies the required environmental reviews.</span></p><p>California officials have challenged the expedited federal process, arguing that BOEM is bound by the Ninth Circuit decision and subsequent district court injunction requiring BOEM to complete a full EIS and comply with the Endangered Species Act (ESA) and Coastal Zone Management Act (CZMA) before approving any permits for well stimulation treatments.</p><p>The federal Coastal Zone Management Act, however, gives the Coastal Commission authority to determine whether federally authorized projects that could affect California&#8217;s coastal resources are consistent with the state&#8217;s federally approved coastal management program.</p><p>The commission&#8217;s objection prevents the federal government from authorizing DCOR&#8217;s proposal unless the company successfully appeals to the U.S. Secretary of Commerce. The companies <a href="https://investor.phillips66.com/financial-information/news-releases/news-release-details/2026/Phillips-66-Kinder-Morgan-and-HF-Sinclair-Announce-Final-Investment-Decision-for-Western-Gateway-Pipeline/default.aspx">announced</a> August 11 that they had finalized a joint venture agreement for the project. Phillips 66 will own 49.9% of the system, Kinder Morgan 35.1% and HF Sinclair 15%.</p><p class="button-wrapper" data-attrs="{&quot;url&quot;:&quot;https://www.californiaenergyjournal.com/subscribe?&quot;,&quot;text&quot;:&quot;Subscribe now&quot;,&quot;action&quot;:null,&quot;class&quot;:null}" data-component-name="ButtonCreateButton"><a class="button primary" href="https://www.californiaenergyjournal.com/subscribe?"><span>Subscribe now</span></a></p><p>The project is a significant private-sector response to the loss of nearly one-fifth of California&#8217;s oil refining capacity. It would establish a direct pipeline connection between California and major U.S. refining centers, potentially reducing the state&#8217;s growing dependence on waterborne fuel imports.</p><p>Western Gateway would have an initial capacity of approximately 230,000 barrels per day and is being designed to accommodate future expansion without requiring additional pipeline construction. The companies are targeting completion in 2029.</p><p><strong>New route would connect California to U.S. refining centers</strong></p><p>Western Gateway would combine approximately 900 miles of new pipeline with existing infrastructure owned by Phillips 66 and Kinder Morgan.</p><p>The pipeline system would require Phillips 66 to build a new Western Gateway Pipeline, which would flow from Borger, Texas, to Phoenix. The company would also reverse its Gold Pipeline, which connects with the Explorer Pipeline, allowing refined products from St. Louis and other Midwest supply points to flow toward Borger.</p><p>Kinder Morgan would contribute its existing SFPP East Line between El Paso, Phoenix and Tucson. Its SFPP West Line, which currently flows east from Colton, California, to Phoenix, would be reversed to move fuel into California.</p><p>Phillips 66 and Kinder Morgan first <a href="https://www.californiaenergyjournal.com/p/phillips66-and-kinder-morgan-propose">proposed the system</a> in October 2025 and subsequently solicited commitments from potential shippers. The final investment decision moves the project beyond the proposal and commercial-development stages, although construction remains contingent on regulatory approval.</p><p><strong>Refinery closures reshape California fuel market</strong></p><p>The project comes as California confronts concerns about fuel availability and affordability after two major refinery shutdowns. Phillips 66 <a href="https://www.californiaenergyjournal.com/p/phillips-66-says-decision-to-close">ceased fuel production</a> at its 139,000-barrel-per-day Los Angeles refinery at the end of 2025. Valero Energy subsequently <a href="https://www.californiaenergyjournal.com/p/valero-to-close-benicia-refinery">ended</a> refining operations at its 170,000-barrel-per-day Benicia refinery in April 2026.</p><p>Western Gateway could replace a substantial portion of the lost in-state production with gasoline, diesel and jet fuel manufactured elsewhere in the United States.</p><p>California is largely isolated from the Gulf Coast and Midcontinent refined-products pipeline network. That isolation has left the state dependent on local refineries and increasingly on imports delivered by ship. The proposed Canopy Offshore Wind project had an estimated potential capacity of approximately 1.6 GW.</p><p>The agreement with the U.S. Department of the Interior covers RWE offshore wind leases off California, New York and Louisiana. The company plans to redirect approximately $900 million toward an investment in a liquefied natural gas project in Louisiana and another $300 million to support natural gas generation projects in the United States.</p><p>The California lease, <a href="https://www.boem.gov/renewable-energy/state-activities/canopy-offshore-wind-llc-ocs-p-0561">OCS-P 0561</a>, is held by RWE subsidiary Canopy Offshore Wind LLC and covers approximately 63,338 acres in federal waters off Humboldt County. RWE won the lease in the Bureau of Ocean Energy Management&#8217;s <a href="https://www.californiaenergyjournal.com/p/boem-holds-first-california-offshore">December 2022 California offshore wind auction</a> and subsequently assigned it to Canopy Offshore Wind.</p><p>BOEM awarded five California offshore wind leases in 2022&#8212;three in the Morro Bay Wind Energy Area and two in the Humboldt Wind Energy Area. At the time of the auction, BOEM estimated that the five lease areas collectively had the potential to support more than 4.6 GW of offshore wind generation. Subsequent state planning estimates have placed the potential capacity of the five lease areas at approximately 4.5 to 7.6 GW as projects and technology have developed.</p><p>California has established a planning goal of developing up to 25 GW of offshore wind capacity by 2045. The California Energy Commission (CEC) estimates that offshore wind could provide approximately 10% to 15% of the state&#8217;s electricity needs.</p><p>Three of those original five leases are now subject to federal agreements to remove them from development.</p><p>In April 2026, Golden State Wind LLC <a href="https://www.doi.gov/pressreleases/interior-announces-two-historic-agreements-promote-affordable-reliable-energy">agreed</a> to relinquish its Morro Bay lease in exchange for a $120 million federal payment. The lease had been intended to support a proposed 2-GW floating offshore wind project.</p><p>In June, Invenergy <a href="https://www.doi.gov/pressreleases/interior-announces-new-energy-agreement-strengthen-american-energy-security-and-lower">agreed</a> to relinquish four offshore wind leases, including its Morro Bay lease, under a $765 million federal agreement. Invenergy had estimated that its California lease could support approximately 1.5 GW of capacity.</p><p>California has <a href="https://www.californiaenergyjournal.com/p/california-to-sue-trump-administration">challenged</a> both Morro Bay lease relinquishment agreements. Attorney General Rob Bonta and the CEC have issued notices of intent to sue the Interior Department, arguing that the federal government violated the Outer Continental Shelf Lands Act and improperly circumvented California&#8217;s role in offshore energy decisions.</p><p>The RWE agreement could now provide the basis for a third California challenge, although the state has not yet announced a notice of intent to sue over the Humboldt lease.</p><p>The Humboldt withdrawal could also have broader consequences than the two Morro Bay cancellations because California has been planning significant infrastructure investments around development of an offshore wind industry along its northern coast.</p><p>The state has spent <a href="https://www.energy.ca.gov/news/2026-07/california-sends-notice-intent-file-second-lawsuit-challenging-trump">more than $100 million</a> preparing ports, transmission systems and other infrastructure for offshore wind development. The project would also recover approximately 14 million barrels of oil and 13 million additional cubic feet of natural gas over the next 20 years that would otherwise remain in the reservoir.</span></p><p><span>The wells are located in federal waters and are therefore not subject to California&#8217;s statewide ban on hydraulic fracturing. The Coastal Commission staff notes, however, that the project lies adjacent to some of California&#8217;s most environmentally sensitive marine resources. The area includes the Channel Islands National Marine Sanctuary, marine protected areas, critical habitat for threatened and endangered species, biologically important whale habitat, essential fish habitat, and productive commercial fishing grounds.</span></p><p><span>A central concern throughout the report is the age of Platform Gilda and its associated infrastructure. The platform and pipelines have operated for approximately 45 years, more than double the 18-year operating life anticipated when originally approved in 1980. Staff concludes that increasing production through hydraulic fracturing would place additional stress on aging wells, pipelines, and processing equipment while substantially increasing the amount of oil transported through the system.</span></p><p><span>The report also cites DCOR&#8217;s recent operating history. The commission staff notes that facilities operated by the company were involved in two of Southern California&#8217;s most significant offshore incidents in recent years&#8212;the 2021 Huntington Beach pipeline spill and the 2026 offshore natural gas leak and platform fire near Carpinteria. According to the report, these incidents demonstrate that inspection and maintenance programs cannot eliminate the risk of spills from aging offshore facilities.</span></p><p><span>The California Coastal Commission will consider the recommendation on August 13, when it considers both DCOR&#8217;s federal consistency certification and a separate </span><a href="https://documents.coastal.ca.gov/reports/2026/8/Th8b/Th8b-8-2026-report.pdf"><span>consistency determination</span></a><span> submitted by the U.S. Bureau of Ocean Energy Management (BOEM).</span></p><p><span>If the Commission adopts staff&#8217;s recommendation and objects to DCOR&#8217;s consistency certification, the company may appeal the decision to the U.S. Secretary of Commerce. Under the Coastal Zone Management Act, the Secretary may override the state&#8217;s objection only if the project is consistent with the objectives of the Act or is necessary in the interest of national security.</span></p><p><span>The project has been part of the Trump administration&#8217;s conflict with California over offshore oil production.
